Confieso que llevo un largo tiempo pendiente de escribir este artículo para mis amigos de Mediavanza. Además de mi ligera debilidad por la procrastinación, me aquejaba cierta falta de inspiración; las musas es lo que tienen, que no le visitan a uno cuando por turno corresponde, sino cuando les viene en gana. En este caso, reflexionando sobre el concepto de conflicto, han sido mis peludos amigos retratados en la fotografía quienes me han brindado un ejemplo perfecto de la práctica de la mediación en la vida cotidiana.
Estos dos cánidos, el más pequeño, un podenco llamado Canelo, y a su lado, un braco de Weimar Coen, tienen la costumbre de disputarse un trozo de cuerda enrollada sobre si misma, su juguete favorito.
Normalmente, dada la mayor fuerza, envergadura y posición dominante del braco, es éste quién primero alcanza el juguete al lanzárselo al espacio. La cosa cambia si el lanzamiento tiene lugar en una pendiente cuesta arriba, cuando Canelo, más ligero en la zancada, atrapa primero el objeto de disputa. Aunque normalmente, en general, ya sea cuesta abajo o en llano, es Coen, el braco, quien se hace con el juguete en primer lugar; el pequeño y bizarro podenco le alcanza y trata de quitárselo, aunque casi siempre sin éxito, de las fauces del mayor.
Es ahí donde aparece el conflicto motivo de esta fábula. Se pueden entrever aquí todos los elementos presentes en el típico conflicto bilateral, dos partes, enfrentadas, disputan -en este caso la posesión- de un mismo objeto, que no son capaces de compartir en armonía. En muchas ocasiones, y quizás más en los animales que las personas, ambas partes son conscientes de que lo fundamental no es la posesión del objeto en sí, sino la relación que el objeto permite que se desarrolle entre las partes, y por ello acaban cediendo de su afán de posesión sobre el objeto, permitiendo que sea el otro quien lo controle durante un rato. En otras, sin embargo, la situación se enquista, y para ambos, se acaba el juego al no poder continuar arrebatándose mutuamente el objeto, lo que es en realidad el fundamento de su actividad lúdica.
Es en esos momentos cuando yo, dueño del podenco y cuidador ocasional del braco, me veo obligado a intervenir. Lo hago muchas veces, con la justificación del menor tamaño, y de que al fin y al cabo es mi perro, en mi condición de abogado de parte. Intervengo en el conflicto, le arrebato, si puedo, la cuerda a Coen, y la vuelvo a lanzar en mejores condiciones para Canelo, cuesta arriba o con algún amago intencionadamente partidista. La desventaja de esta intervención, en la que en este caso acabo haciendo las veces de juez, es que el perro desfavorecido se da cuenta de la treta y pierde interés en el juego, perdiendo también el interés, a continuación, y sin remedio, el otro contendiente, Canelo, que no encuentra la gracia en dominar el juguete si no se le disputa. Por eso, últimamente, renuncio a la toga y con ello a las soluciones que ponen punto final al asunto, y actúo como un verdadero mediador. Esta transfiguración no resulta sencilla y sí muy exigente, pero permite apreciar las cosas en una dimensión completamente nueva, más amplia y conciliadora. Además, si tengo éxito, la relación continúa durante mucho más tiempo (y los perros me dejan en paz).
La exigencia y dificultad radica en poner la observación y atención a las características del conflicto en primer lugar. En aplazar o incluso renunciar a la búsqueda de la solución a cambio de desnudar el conflicto, de desvestirlo de los elementos que bloquean la continuidad de la relación para permitir que por sí mismo se desvanezca. En casi todo conflicto, cuando se examina desde este prisma, subyace el ánimo de las partes por seguir manejándose en armonía con lo que ahora aparece como elemento conflictual. Pero subyace latente, escondido bajo las demandas de solución, victoria y aplastamiento de la contraparte, destacadas en primer plano por la ceguera momentánea que nos provoca la situación de batalla.
Es esta la tarea y principal cometido del mediador. No se trata de encontrar la solución al conflicto y acabar con el problema. Eso resulta sencillo y encuentra su amparo en los tribunales. Se trata de ayudar a las partes, desanudando el conflicto, a entender el origen y perfiles de este, a darse cuenta de lo que les une, a permitirles apreciar por ellos mismos la relación que hubo, hay y podría haber en el futuro, en toda su dimensión; para finalmente darle nueva forma, retocándola si ha lugar, para continuar relacionándose, ya sin la presencia de elementos conflictivos. Debe guiar nuestra actuación un principio de intervención mínima, a riesgo de llevarnos una dentellada si nuestra participación nos inmiscuye en el conflicto. Es muchas veces suficiente prestar atención, esperar el momento, un firme y oportuno shhhh que evite la escalada de agresión que empieza por un tímido gruñido e impide un sano y recíproco intercambio en el juego.
En definitiva, se trata de entender y hacer entender que la mejor solución a un problema no pasa por decidir quien lleva razón y quien no, muerto el perro se acabó la rabia; sino la que permite que siga el juego, vacunados de la rabia.
I confess that I have been waiting for a long time to write this article for my friends at Mediavanza. In addition to my slight weakness for procrastination, I suffered from a lack of inspiration; the muses don’t visit you at your convenience, but when they feel like it. In this case, reflecting on the concept of conflict, it has been my furry friends portrayed in the photograph who have given me a perfect example of the practice of mediation in everyday life.
These two canids, the smallest, a hound named Canelo, and next to him, a Weimaraner Coen, have the habit of fighting over a piece of rope wrapped around itself, their favorite toy.
Normally, given the greater strength, wingspan, and dominant position of the latter, who reaches the toy first when thrown into space. Things change if the throw takes place on an uphill slope, when Canelo, lighter in his stride, catches the object of contention first. Although usually, in general, whether downhill or flat, it’s Coen who gets the toy first; the small on tries to take the toy away, although almost always without success, from the jaws of the older one.
It is there where the conflict motive of this fable appears. One can glimpse here all the elements present in the typical bilateral conflict, two parties, facing each other, dispute -in this case the possession- of the same object, which they are not capable of sharing in harmony. On many occasions, and perhaps more so in animals than in people, both parties are aware that what is fundamental is not the possession of the object itself, but rather the relationship that the object allows to develop between the parties, and for this reason they end up giving up their eagerness to possess the object, allowing the other to control it for a while. In others, however, the situation becomes entrenched, and for both, the game is over as they cannot continue snatching the object from each other, which is the foundation of their playful activity.
It is in those moments when I, owner of Canelo and occasional caretaker of Coen, am forced to intervene. I do it many times, with the justification of the smaller size, and that after all it is my dog, in my capacity as a lawyer. I intervene in the conflict, I snatch, if I can, the rope from Coen, and I throw it back in better conditions for Canelo, uphill or with some intentionally partisan feint. The disadvantage of this intervention, in which in this case I end up acting as judge, is that the disadvantaged dog realizes the ruse and loses interest in the game, also losing interest, then, and without remedy, the other contender, Canelo, who does not find the grace to dominate the toy if it is not disputed. For this reason, lately, I have renounced the toga and with it the solutions that put an end to the matter, and I act as a true mediator. This transfiguration is not easy, and it is very demanding, but it allows us to appreciate things in a completely new, broader, and more conciliatory dimension. Also, if I’m successful, the relationship continues for much longer (and the dogs leave me alone).
The requirement and difficulty lie in putting observation and attention to the characteristics of the conflict in the first place. In postponing or even giving up the search for a solution in exchange for stripping the conflict bare, stripping it of the elements that block the continuity of the relationship to allow it to fade by itself. In almost all conflicts, when examined from this perspective, there is the spirit of the parties to continue managing in harmony with what now appears as a conflictive element. But it lies latent, hidden under the demands for a solution, victory and crushing of the counterpart, highlighted in the foreground by the momentary blindness that the battle situation causes us.
This is the task and main task of the mediator. It is not about finding a solution to the conflict and ending the problem. That is simple and finds its protection in the courts. It is a question of helping the parties, by unraveling the conflict, to understand its origin and profiles, to realize what unites them, to allow them to appreciate for themselves the relationship that was, is and could be in the future, in all its dimension; to finally give it a new shape, retouching it if necessary, to continue relating, now without the presence of conflicting elements. Our actions must be guided by a principle of minimal intervention, at the risk of taking a bite if our participation intrudes us into the conflict. It is often enough to pay attention, wait for the moment, a firm and opportune silence that prevents the escalation of aggression that begins with a timid growl and prevents a healthy and reciprocal exchange in the game.
In short, it is about understanding and making people understand that the best solution to a problem does not involve deciding who is right and who is wrong, but the one that allows the game to continue.
